Common requests for Information

NOTE: In assessing all informal and formal GIPA Act Applications, Council searches both manual and electronic databases relating to any known and available development and building applications.

Where permitted, Council will provide copies (electronic at no cost, or printed as per Council’s advertised fees and charges schedule) of non-copyright documents. All documents on files can be viewed by applicants, in person, at an agreed time at Council’s offices. However, no copyright material can be copied by any means.

Applicants, and their agents, are reminded that the provision of these documents does not represent compliance with matters covered by Sect 6.25 or 6.26 of the Environmental Planning And Assessment Act 1979 in respect of building information certificates and does not prevent Council making orders if other information is subsequently discovered.

The following items are common requests made to Council under the Government Information (Public Access) Act 2009 (GIPA Act). The following information may assist you in accessing similar information from Council:

 

Development Application information

Development applications and any associated documents received in relation to a proposed development application, made after 1 July 2010, forms part of Council’s ‘open access‘ information and is available to view and obtain free of charge.

To request copies of  development application information please complete our Informal Access to Information Request form and email to mail@cgrc.nsw.gov.au

From 31 August 2018 Development applications and decisions made before 1 July 2010, no longer falls withing the definition of ‘open access’ information for local government. This information will continue to be ‘government information’ within the meaning of the GIPA act and still can be accessed to view, or to obtain copies, via an informal access to information request form.

 

Neighbouring Property Owners Details

Council recognises that members of the public often need to obtain the contact details of the owner of a neighbouring property for fencing purposes under the Dividing Fences Act 1991. We will provide the name and postal address of the adjoining property owner upon verification of your identity as the owner of your property.

 

Architectural Plans (House Plans)

House plans and other material held by Council may be subject to copyright protection under the Copyright Act 1968 (Cth). In addition, the security of the occupier may be compromised if copies of floor plans are provided without the property owner’s consent. For these reasons, the following conditions are imposed for informal access to architectural plans:

  1. Council will provide viewing access and copies of house plans which merely show a property’s height and its external configuration in relation to the site, in other words, the site plan and site elevation drawings not subject to copyright;
  2. ‘View only’ access will be provided to floor plans of a property during the determination process;
  3. ‘View only access will be provided to floor plans of a property after the determination process with the property owners consent;
  4. Copies of documents subject to copyright protection will not be provided unless Council receives the express written consent from the copyright owner or property owner.
