WHAT APPROVALS YOU NEED FOR YOUR PROPOSED DEVELOPMENT, HOW TO PREPARE YOUR APPLICATION AND HOW TO LODGE IT FOR ASSESSMENT

The planning system in New South Wales can at times seem overwhelming and complex. Council staff have developed a comprehensive Development Application Guide and some factsheets to help you through how it all works and what to do if you are thinking about undertaking a development.

There are several types of development including;

  • Exempt Development (minimal environmental impact and meets specific standards. Does not need approval)
  • Compling Development (low impact and meets specific standards. A fast track approval)
  • Local Development (needs Development Consent from Council)
  • Integrated, designated and state significant Development (needs approvals or input from state agencies)

Seeking advice from Council prior to submitting an application can assist in identifying shortfalls in lodgement requirements, increase knowledge of planning controls and reduce delays.  A well prepared application is a good application that progresses smoothly through the planning system.

The submission of inadequate information, a lack of knowledge about the planning process and incomplete knowledge of Council’s controls can often lead to lengthy and frustrating delays in development applications being assessed.

Statement of Environmental Effects

A Statement of Environmental Effects (SEE) is a report outlining the likely impacts of your proposal, and the proposed measures that you will undertake to mitigate those impacts.  The Environmental Planning & Assessment Regulations, 2000, stipulates that a development application MUST be accompanied by a SEE.

Council has developed a Statement of Environmental Effects Guide -(SEE) STATEMENT OF ENVIRONMENTAL EFFECTS (SEE) GUIDE WEB VERSION and some template SEEs. The template SEEs can be used for the basic developments listed below, however for complex developments or complex sites where additional information may be required, a more detailed written SEE that considers these complexities should be submitted.

What application forms do you need?

Council staff have prepared DA Packs for basic developments. These are available from Customer Service or you can download all the required applications and the appropriate checklist from the Application Forms and Checklists page.

Depending on your development you may be required to complete additional applications i.e. to install a manufactured home, install a septic tank, construct a driveway

SECTION 68 ACTIVITY APPLICATIONS

Section 68 of the Local Government Act 1993 specifies a wide range of activities where approvals are required to be obtained from Council. These approvals are often in addition, or ancillary to, a development application (DA).

Some common activities that require approval under section 68 include:

  • Water supply, sewerage and stormwater drainage works,
  • Operate an on-site sewage management system
  • Management of Waste
  • Install a manufactured home, moveable dwelling or associated structures
  • Install a domestic oil or solid fuel heating appliance (wood fire)
  • Busking
  • Operate a Mobile Food Vans
  • Operate a caravan park or camping ground
  • Operate an amusement device.

 LIQUID TRADE WASTE (LTW) APPLICATIONS

In 2018 Council adopted a Liquid Trade Waste Policy.  Liquid trade waste is any discharge to a sewerage system other than domestic waste from a hand wash basin, shower, bath or toilet.

Why is it important?

Our sewerage systems are designed to handle domestic wastewater which is predictable in strength and quality. The unpredictable nature of liquid trade waste may have a significant impact, and put greater demands, on our sewerage system. This can impact on the system functionality, operating costs, work health and safety, public health and the environment.

The LTW Policy enables Council to:

  • meet its requirements under the NSW Framework for Regulation of Sewerage and Trade Waste;
  • adopt a risk management framework for protecting the community and the environment; and
  • provide economic incentives for trade waste discharges to conserve water, minimise their trade waste and to consistently comply with their conditions of approval.

Approvals

A Liquid Trade Waste Approval is a Section 68 Approval, to discharge liquid waste into Council’s sewer. An Annual fee will be levied on the rates of the property and will be based on the assessed category of the discharger. Current Fees and Charges are available on Council’s website.

OUTDOOR DINING AND STREET DINING

In 2018 Council adopted a Footpath Trading and Outdoor Dining Policy to encourage outdoor dining and street trading. The Policy establishes guidelines for the placement of most items that you may like to place on or above the footpath – signs, tables and chairs, clothes racks, displays etc. and is applicable in all areas of the Council area.
